These Terms of Service (“Terms”) govern your access to and use of www.inkfxprinting.com (the “Website”) and any products or services provided by Ink FX Printing (“Company,” “we,” “us,” or “our”). By accessing this Website or placing an order, you agree to be legally bound by these Terms. If you do not agree, you may not use the Website or our services.

1. Eligibility & Use of Website

You represent that you are at least eighteen (18) years old or accessing the Website under the supervision of a parent or legal guardian. You agree to use the Website only for lawful purposes and in accordance with these Terms.

We reserve the right to suspend or terminate access to the Website at any time for violations of these Terms.

2. Products & Services

Ink FX Printing provides custom printing services and related products. All products are subject to availability. We reserve the right to modify or discontinue any product or service without notice.

Product images and descriptions are for illustrative purposes only and may not exactly match the final printed product due to variations in printing processes, materials, and colour calibration.

3. Custom Orders & Final Sale

Due to the custom nature of our products, all custom orders are final sale. No returns, refunds, or exchanges will be issued except in cases of printing defects caused solely by Ink FX Printing.

4. Artwork, Content & Intellectual Property Rights

By submitting artwork, logos, text, or other materials (“Customer Content”), you represent and warrant that:

  • You own or have obtained all necessary rights, licenses, and permissions to use the Customer Content

  • The Customer Content does not infringe any intellectual property, privacy, or publicity rights

  • The Customer Content does not contain unlawful, defamatory, obscene, or offensive material

You grant Ink FX Printing a limited, non-exclusive license to reproduce, modify, and print Customer Content solely for the purpose of fulfilling your order.

You agree that Ink FX Printing shall not be responsible for verifying ownership or permissions related to Customer Content.

5. Proof Approval & Customer Responsibility

Customers are solely responsible for reviewing and approving all proofs prior to production. Approval constitutes acceptance of the design in its entirety.

Ink FX Printing shall not be liable for any errors, including but not limited to spelling, grammar, layout, colour, or sizing, once proof approval has been granted.

6. Pricing, Taxes & Payment

All prices are listed in [AUD] unless otherwise stated and are subject to change without notice. Payment must be received in full prior to production.

You are responsible for any applicable taxes, duties, or fees imposed by governmental authorities.

7. Order Cancellations & Modifications

Orders may be cancelled or modified only before production begins. Once production has commenced, no cancellations, modifications, or refunds will be permitted.

8. Shipping & Delivery

Shipping and delivery dates are estimates only and not guaranteed. Ink FX Printing is not responsible for delays, loss, or damage caused by shipping carriers or events beyond our control.

Risk of loss passes to the customer upon delivery to the carrier.

9. Returns & Refunds

Our Return & Refund Policy is incorporated into these Terms by reference. In the event of a verified printing defect caused by Ink FX Printing, our sole obligation is, at our discretion, to reprint or replace the defective product.

10. Website Content & Ownership

All Website content, including text, graphics, logos, images, and software, is the property of Ink FX Printing or its licensors and is protected by applicable intellectual property laws. Unauthorized use is strictly prohibited.

11. Disclaimer of Warranties

The Website and all products and services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

12. Limitation of Liability

To the fullest extent permitted by law, Ink FX Printing shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Website or products.

Our total liability for any claim shall not exceed the amount paid by you for the specific product giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Ink FX Printing, its owners, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:

  • Your breach of these Terms

  • Your submitted Customer Content

  • Your misuse of the Website or products

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Queensland, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located within that state.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
